1. Acceptance of Terms

By accessing or using the Barberos application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and RuyaTech ("Company," "we," "our," or "us").

If you do not agree to these Terms, you may not access or use our Service. These Terms apply to all users of the Service, including barbershop owners, managers, staff members, and customers.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notifications. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

You must be at least 18 years old and have the legal capacity to enter into this agreement. By using our Service, you represent and warrant that you meet these requirements.

Important: By using Barberos, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

2. Service Description

Barberos is a comprehensive barbershop management and online appointment booking system that includes:

2.1 Mobile Application

  • Account management for barbershop owners, managers, barbers, and staff
  • Appointment scheduling and calendar management
  • Point of Sale (POS) system for checkout and payments
  • Business analytics and reporting tools
  • Staff performance tracking and management
  • Product and inventory management
  • Customer relationship management

2.2 Public Booking Website

  • Online appointment booking for customers (no account required)
  • Service selection and professional booking
  • Group booking capabilities
  • Appointment confirmation and verification system
  • Online rescheduling and cancellation options

2.3 Backend Services

  • Secure APIs and data management
  • Payment processing through Stripe
  • Automated notifications (SMS/Email)
  • Subscription and billing management
  • Data analytics and insights

Barberos operates on a subscription-based model, providing ongoing access to our platform and services for managing barbershop operations.

3. User Accounts and Registration

3.1 Account Creation

To use the Barberos mobile application, you must create an account. During registration, you must provide accurate, current, and complete information as prompted by our registration forms.

3.2 Account Types

  • Owner: Full administrative access to barbershop management features
  • Manager: Administrative access with permissions set by the owner
  • Barber: Access to personal schedule, appointments, and basic POS functions
  • Staff/Front Desk: Limited access for appointment management and customer service

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account
  • Ensuring that your account information remains accurate and up-to-date

3.4 Authentication Methods

You may sign in using:

  • Email address and password
  • Google OAuth authentication

3.5 Account Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or pose a security risk to our platform or other users.

4. Subscription Plans and Billing

4.1 Subscription Plans

  • Basic Plan: Supports 1 barber with essential features
  • Small Shop Plan: Supports up to 3 barbers with full features
  • Custom Plan: Tailored solutions for larger barbershops
  • Additional Barbers: Extra barbers can be added for an additional fee

4.2 Free Trial

All new barbershop registrations receive a 30-day free trial with full access to features. No payment information is required to start your trial.

4.3 Billing and Payments

  • All payments are processed securely through Stripe
  • Subscriptions automatically renew at the end of each billing cycle
  • You will be charged in advance for each billing period
  • All fees are non-refundable except as expressly stated in these Terms
  • We accept major credit cards and other payment methods supported by Stripe

Payment Security

All payment processing is handled securely by Stripe, our PCI-compliant payment processor. We never store credit card information on our servers.

4.4 Plan Changes

  • Upgrades: Take effect immediately with prorated billing
  • Downgrades: Take effect at the next billing cycle
  • You can change your plan at any time through your account settings

4.5 Payment Failures

If a payment fails, we will attempt to process the payment again. If payment continues to fail, your account may be suspended until payment is resolved.

4.6 Price Changes

We reserve the right to modify our pricing. Existing subscribers will be notified at least 30 days in advance of any price changes. Price changes will take effect at the next billing cycle.

4.7 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial billing periods
  • Upon cancellation, you retain access to paid features until the end of the billing period

5. Customer Bookings (Public Website)

5.1 No Account Required

Customers can book appointments through our public website without creating an account. They need only provide their name, phone number, and optionally an email address.

5.2 Booking Process

  • Customers select services, time slots, and preferred professionals
  • A verification email is sent to confirm the booking
  • Bookings are pending until email verification is completed
  • Only verified bookings appear in the barbershop's calendar

5.3 Customer Rights

  • Modify appointment details before the scheduled time
  • Cancel bookings with reasonable notice
  • Reschedule appointments based on availability
  • Receive confirmation and reminder notifications

5.4 Group Bookings

Customers may book appointments for multiple people, subject to barbershop availability and policies. Group bookings are confirmed only when sufficient staff and time slots are available.

5.5 No-Show Policy

Individual barbershops may establish their own no-show and cancellation policies. Barberos provides tools to manage these policies but does not enforce specific penalties.

6. User Responsibilities

6.1 Business Information

Barbershop owners and managers must:

  • Provide accurate business information (name, address, contact details)
  • Keep business hours and availability information current
  • Maintain accurate service and pricing information
  • Update staff information and permissions as needed

6.2 Appointment Management

  • Honor confirmed appointments or provide reasonable notice of changes
  • Maintain professional standards in customer service
  • Use the scheduling system responsibly to avoid conflicts
  • Update appointment statuses accurately (completed, no-show, cancelled)

6.3 POS System Usage

  • Process transactions accurately and honestly
  • Maintain proper records of all sales and services
  • Use the system only for legitimate business purposes
  • Report any discrepancies or technical issues promptly

6.4 Legal Compliance

Users must:

  • Comply with all applicable local, state, and federal laws
  • Maintain required business licenses and permits
  • Follow health and safety regulations
  • Respect customer privacy and data protection laws

6.5 Prohibited Activities

You may NOT:

  • Use the Service for any illegal or fraudulent purposes
  • Attempt to gain unauthorized access to other users' accounts
  • Interfere with or disrupt the Service or servers
  • Upload malicious software or harmful content
  • Violate the intellectual property rights of others
  • Harass, abuse, or harm other users
  • Use the Service to spam or send unsolicited communications

7. Intellectual Property Rights

7.1 RuyaTech Ownership

The Barberos application, including all software, designs, text, graphics, logos, and other content (excluding user-generated content), is owned by RuyaTech and protected by intellectual property laws.

7.2 License Grant to Users

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Barberos Service for your legitimate business purposes.

7.3 User-Generated Content

You retain ownership of content you upload to Barberos (such as business photos, logos, and information). By uploading content, you grant us a license to use, display, and store such content as necessary to provide the Service.

7.4 Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Service
  • Create derivative works based on the Service
  • Remove or modify any copyright, trademark, or other proprietary notices
  • Use our trademarks or branding without written permission
  • Access the Service to build a competing product or service

7.5 Copyright Infringement

If you believe that content in our Service infringes your copyright, please contact us at support@ruyatech.com with details of the alleged infringement.

8. Third-Party Services

8.1 Integrated Services

Barberos integrates with the following third-party services:

  • Stripe: Payment processing and subscription management
  • Firebase: Analytics, crash reporting, and backend services
  • Google OAuth: Authentication and sign-in services
  • Email/SMS Providers: Notification delivery services

8.2 Third-Party Terms

Your use of third-party services through Barberos is subject to the respective third-party terms of service and privacy policies. We encourage you to review these terms.

8.3 No Liability for Third-Party Services

RuyaTech is not responsible for the availability, functionality, or policies of third-party services. Any issues with third-party services should be addressed directly with the respective providers.

8.4 Changes to Third-Party Services

Third-party services may change their terms, pricing, or availability. Such changes may affect Barberos functionality, and we will make reasonable efforts to notify users of significant impacts.

9. Data and Privacy

9.1 Privacy Policy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

9.2 Data Security

We implement industry-standard security measures to protect your data, including encryption, secure authentication, and access controls. However, no system is completely secure, and we cannot guarantee absolute security.

9.3 User Data Ownership

You retain ownership of your business data and customer information. We process this data solely to provide our services as outlined in our Privacy Policy.

9.4 Data Processing Rights

By using Barberos, you grant us the right to process your data as necessary to provide our services, including analytics, billing, and customer support.

9.5 Compliance

We comply with applicable data protection regulations, including GDPR and CCPA, where applicable. Users are responsible for ensuring their own compliance with local data protection laws.

10. Service Availability and Modifications

10.1 Service Uptime

We make reasonable efforts to maintain high service availability, but we do not guarantee uninterrupted access to Barberos. Service may be temporarily unavailable due to maintenance, updates, or technical issues.

10.2 Scheduled Maintenance

We may perform scheduled maintenance that temporarily affects service availability. When possible, we will provide advance notice of scheduled maintenance.

10.3 Service Modifications

We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of significant changes that may affect your use of the Service.

10.4 Service Discontinuation

In the unlikely event that we need to discontinue the Service entirely, we will provide at least 90 days' notice and assistance in data export where feasible.

11. Limitation of Liability

11.1 "AS IS" Service

The Barberos Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2 No Business Loss Liability

RuyaTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses.

11.3 Maximum Liability

In no event shall RuyaTech's total liability to you exceed the amount of subscription fees paid by you in the twelve (12) months preceding the incident giving rise to liability.

11.4 Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

11.5 Third-Party Actions

We are not responsible for the actions, content, or data of third parties, and you release us from any claims and damages arising from or related to third parties.

12. Indemnification

You agree to defend, indemnify, and hold harmless RuyaTech, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your business operations and customer interactions
  • Any content you upload or transmit through the Service
  • Your breach of any laws or regulations

13. Termination

13.1 Termination by User

You may terminate your subscription and close your account at any time through your account settings. Termination will be effective at the end of your current billing period.

13.2 Termination by RuyaTech

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activities, or pose a security risk to our platform or other users.

13.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease
  • Your data may be deleted after a reasonable grace period
  • Outstanding fees remain payable
  • You should export any important data before termination

13.4 Survival

Provisions regarding intellectual property, indemnification, limitation of liability, and dispute resolution will survive termination of these Terms.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Tunisia, without regard to conflict of law principles.

14.2 Informal Resolution

Before pursuing formal legal action, you agree to first contact us at support@ruyatech.com to seek an informal resolution of any dispute.

14.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the arbitration rules of Tunisia. The arbitration shall be conducted in Tunisia, and the decision of the arbitrator shall be final and binding.

14.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RuyaTech regarding the use of the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

16. App Store Specific Terms

16.1 Apple App Store

If you download the Barberos app from the Apple App Store, you acknowledge that these Terms are between you and RuyaTech only, not with Apple. Apple is not responsible for the Service or any claims relating to it. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.

16.2 Google Play Store

If you download the Barberos app from Google Play, you acknowledge that these Terms are between you and RuyaTech only, not with Google. Google is not responsible for the Service or any claims relating to it.

16.3 App Store Provider Responsibilities

  • App store providers have no obligation to furnish maintenance and support services
  • RuyaTech is solely responsible for product support and maintenance
  • App store providers are not responsible for addressing any claims you may have
  • In case of third-party claims of intellectual property infringement, RuyaTech, not the app store provider, will be responsible for investigation and resolution
